The Board of Education will meet in Closed Session to discuss matters of student discipline, employee contract matters, and personnel matters.

Dr. Martinrex Kedziora, Assistant Superintendent of Educational Services will introduce the following schools and announce their achievements:

Canyon Springs AFJROTC Briefing, Directed by Sgt. Ruben Martinez of Canyon Springs High School - Cadets Ariana Segovia, Melissa Pedrero, and Olivia Von Barnau Sythoff from Canyon Springs High School will present a briefing to the Board of Education.

Canyon Springs High School Charter Hospice, Directed by Bonnie Beck of Charter Hospice and assisted by Cindy Acosta, Receptionist at Canyon Springs High School - The Board of Education would like to recognize the Canyon Springs High School Charter Hospice students for participating in this charitable program; by visiting the sick and elderly patients in nursing homes throughout Riverside and Moreno Valley. Students are transported every other Saturday to nursing homes to read, play games and interact with patients. The Charter Hospice Program Director, Bonnie Beck, will be present to support the Canyon Springs High School students.  Cindy Acosta, Receptionist at Canyon Springs High School, helps facilitate this valuable program between Canyon Springs High School and Charter Hospice.

7. Public Comments on Non-Agenda Items     
 

The Board of Education encourages public comments. During this section, staff may briefly respond to statements or questions or may ask questions for clarification. The Board may refer to staff or other resources for factual information, direct staff to report back at a subsequent meeting, and/or direct staff to place the topic on a future agenda.

If someone wants to lodge a complaint against an employee, the appropriate form may be obtained at any school or the Community Education Center.

Individual speakers shall be allowed to speak for a total of three minutes on non-agenda items regardless of the number of issues to be addressed by the individual The Board of Education shall limit the total time for public input on non-agenda items to 21 minutes.

With Board of Education consent, the president may increase or decrease the time allowed for public presentation, depending on the topic and the number of persons wishing to be heard.  The President may take a poll of speakers for or against a particular issue and may ask that additional persons speak only if they have something new to add. 8. SUPERINTENDENT'S REPORT

1. PUBLIC HEARING TO REVIEW AND CONSIDER ADOPTION OF A REPORT ENTITLED “SCHOOL FACILITIES NEEDS ANALYSIS,” PREPARED AS OF APRIL 11, 2013 (“2013 SFNA”), TO CONSIDER AND RESPOND TO CONSIDER AND RESPOND TO ALL COMMENTS RECEIVED BY THE MORENO VALLEY UNIFIED SCHOOL DISTRICT RELATED THERETO, AND TO ADOPT ALTERNATIVE SCHOOL FEES.     
 

A Public Hearing will be conducted to review and consider adoption of a report entitled "School Facilities Needs Analysis," prepared as of April 2013 ("2013 SFNA"), to consider and respond to all comments received by the Moreno Valley Unified School District related thereto, and to adopt alternative school fees.

The Board President will open the Public Hearing and ask if there are any public comments.  After public comments or if there are no public comments, the Board President will ask for a motion to close the Public Hearing.

2. RESOLUTION NO. OF THE BOARD OF EDUCATION OF THE MORENO VALLEY UNIFIED SCHOOL DISTRICT APPROVING A SCHOOL FACILITIES NEEDS ANALYSIS, ADOPTING ALTERNATIVE SCHOOL FACILITY FEES IN COMPLIANCE WITH GOVERNMENT CODE SECTIONS 65995.5, 65995.6 AND 65995.7, ADOPTING RESPONSES TO PUBLIC COMMENTS RECEIVED AND MAKING RELATED FINDINGS AND DETERMINATIONS     
 

In order to impose alternative school fees (“Alternative School Fees”), also known as Level 2 Fees and Level 3 Fees, a school district must meet specified statutory requirements set forth in Government Code Sections 65995.5, 65995.6 and 65995.7, as well as Education Code Section 17620.  In general, Alternative School Fees apply solely to new residential construction within that school district and are in excess of the Level 1 Fee currently authorized by the State Allocation Board (“SAB”).  The Level 2 Fee is intended to represent fifty percent (50%) of a school district’s school facilities costs, and applies when the SAB is apportioning State Funding to school districts.  The Level 3 Fee is intended to represent one hundred percent (100%) of a school district’s school facility costs and may be imposed when the SAB is no longer apportioning State Funding.  Level 3 Fees are currently suspended pursuant to Government Code Section 65995.7(a)(3).  In order to impose Alternative School Fees, the Moreno Valley Unified School District (“District”) must prepare and adopt a school facilities needs analysis (“SFNA”) as required by Government Code Section 65995.5(b).  Special District Financing & Administration has prepared the 2013 SFNA, for consideration of adoption by the Board of Education.

In compliance with Government Code Section 65995.6(a), the 2013 SFNA includes projections of the number of unhoused pupils generated by various types of new residential units in each category of pupils enrolled in the District.  The projection of unhoused pupils is based on the historical generation rates of new residential units constructed during the previous five years that are of a similar type of units to those anticipated to be constructed either in the District or the city or county in which the District is located, and relevant planning agency information, such as multi-phased development projects, that may modify the historical figures.  The 2013 SFNA also contains an updated calculation of existing school building capacity, calculated pursuant to Education Code Section .

As set forth in the 2013 SFNA, the Level 2 Fee amount has been calculated as Four and 02/100 Dollars ($4.02) per square foot of assessable space for new residential construction within the District.

The 2013 SFNA must be considered by the Board after a public hearing is held wherein the Board is required to respond to all comments received by the District on the proposed 2013 SFNA during the thirty (30) day review period.  The 2013 SFNA has been on file and available for public review at the District’s offices for a period of thirty (30) days prior to the public hearing of the Board.  The District has complied with the requirements of Government Code Section 65352.2(c) prior to the completion of the 2013 SFNA by providing notice and offering to meet with the planning commission or agency of the cities and counties with land use jurisdiction within the District.  In addition, the 2013 SFNA was provided to such local agencies responsible for land use planning for review and comment prior to the thirty (30) day public review period.  Notice of the time and place of the public hearing of the Board, including the location and procedure for viewing a copy of the 2013 SFNA was posted in the District’s offices, and published in a newspaper of general circulation within the jurisdiction of the District not less than thirty (30) days prior to the public hearing.  A copy of the 2013 SFNA was mailed not less than thirty (30) days prior to the public hearing to any person who made a written request at least forty-five (45) days prior to the public hearing.

After the public hearing, the Board shall consider whether to approve the 2013 SFNA and adopt by resolution a change in the Alternative School Fees to the amounts justified by the 2013 SFNA and Government Code Section 65995.5.  After adoption, the Board must give notice to all affected city and county planning officials within the District’s boundaries.

The City of Moreno Valley (“City”) has requested that the Moreno Valley Unified School District (“District”) dedicate to the City property owned by the District along Nason Street (“Property”) for construction and maintenance of certain sidewalk and related improvements.  The City has also requested a temporary Right of Entry (“Right of Entry”), to allow the City additional access to surrounding property to complete the identified sidewalk and related improvements.  District staff believes that having such improvements in place will enhance student and public safety and access.  District staff believes, therefore, that dedicating the property will be in the District’s best interest.

Education Code Section 17556 et seq. sets forth procedures for dedication of school district property for public street and utility purposes, which includes requirements for: (1) adoption of a “Resolution of Intent” to dedicate the property; (2) a public hearing, after notice, regarding the dedication of the property; and (3) subsequent adoption of a Resolution approving the dedication of the property.

On April 16, 2013, the Board of Education (“Board”) adopted Resolution No. declaring the Board’s intent to dedicate the easement.  Notices have been published and posted as required by law.

The subject of this Agenda Item is the public hearing and Resolution approving the dedication of the property to the City.  The Resolution provides that, on May 14, 2013, the Board shall conduct a public hearing and, if there has not been a protest by ten percent of the qualified electors of the District, approve the dedication of the property to the City.  In approving the dedication, the Board may also authorize the execution of the Right of Entry.

The Resolution must be approved by a two-thirds vote of the Board.

Amendment of Contract -A-12/13-1356 with Hemet Unified School District is being presented for approval.  The original Agreement was submitted on August 7, 2012.  At that time, the Board approved the contract and requested staff provide a report with specific details on utilizing this service. Hemet USD provides on-call student transportation services for the District.  The amended contract extends the contract from February 16, 2013 - June 30, 2013.

3. RESUBMISSION OF FIRST READING BOARD POLICY 3100     
 

At the December 11, 2012,  Board Policy 3100 was presented for First Reading.  At that meeting, an additional change was recommended and the policy was brought back for review on January 22, 2013.  At that meeting, the Board asked for further clarification on the policy and requested staff review and discuss the policy further with the Budget Advisory Committee. 

The Budget Advisory Committee has met and clarified the language in the policy. Board Policy 3100 is being re-submitted for First Reading.

1. APPROVE DECLARATION OF NEED FOR FULLY QUALIFIED EDUCATORS FOR THE 2013-13 SCHOOL YEAR      (D)  (V)  
 

Title 5, Section 80026 allows school districts to request Emergency Permits if there is an insufficient number of certificated persons who meet the District's specified employment criteria to fill necessary positions.  Exemptions such as Emergency Permits are warranted when persons holding appropriate credentials or certificates are not available and existing staff are not legally certified to be assigned to a particular subject area, grade level, or group of students.  In accordance with the Commission on Teacher Credentialing requirements, submission of a Declaration of Need for Fully Qualified Educators by the employing agency shall be a prerequisite to the issuance of any Emergency Permit by that agency.

In accordance with Education Code Section 44300 staff is recommending the Board of Education adopt the attached Declaration of Need for Fully Qualified Educators, which shall be valid until June 30, 2014.
